Thread: ABC Songbook

    Re: ABC Songbook

    I don't see what the big deal is. As long as you put who the music was done by......as in giving credit, for example, written by Metallica or something. There should not be any problem. When you take their song and pur your name in, there is the problem.

    Just to clarify giving credit to the composer isn't the only problem. It's that the composer has the right to say they don't want you making a version of it. So for example, a composer could theoretically come back and say "I don't want you handing out my songs in LOTRO" and they could keep you from doing it. For example, maybe the song is owned by a company who is a competitor of the publishers of this game, and they don't want their songs being handed out for free here? Or, on the flip side, maybe the composer likes the game and would like to be able to make a deal with Turbine to sell abc versions of their music for $0.25 or so on the Turbine website, but by giving their song out for free it's interfering with that plan. So even though they like the game and might even like your version of their music, from a business standpoint they'd still want you to take it down.

    Of course those are hypothetical situations, but they illustrate why I don't think giving credit to the composer is the only issue. The other bigger issue is getting permission to post the song in the first place.

    Fortunately at this point all the music from the 19th century and earlier is public domain. So I can post the Beethoven Bagatelle I was finishing up ....

    Re: ABC Songbook

    A bagatelle by Beethoven. It sounded reasonable on my lute, although I think the bass line tended to be a bit rough. If I had to guess I'd say it will probably sound a little better on a harp, but I'll have to leave that to you harp players to judge.

    P.S. As an interesting bit of background, Beethoven wrote three sets of Bagatelles, but his most famous is "Bagatelle in A minor", more commonly known as Fur Elise, which I posted previously. So while this and Fur Elise don't exactly sound the same, they are in fact both Beethoven bagatelles.

    Pearl Jam lets their fans bootleg their concerts. Neil Young streams his music on the internet for free. They would be the last people to sue you for transcribing their songs. Pearl Jam's official statement on bootlegs is that as long as you aren't profiting off of it then it's ok. Sharing is Ok. Selling is not ok. As far as I know, no one is selling their ABC files.

    Besides all these songs are being credited to their original composers and there are cover bands that cover these songs every day. They don't get sued. All the midi's I've used to make ABC are available for FREE on the internet. If the midi's are free and those web sites don't get sued then I don't see how you could be sued for making it playable in an MMO. People are way too paranoid around here I think you all need to lay off the pipeweed.

    That's nice to hear about Pearl Jam and Neil Young and the free midis. It doesn't really change anything, though. As I said a few posts up any composer has the right to restrict who can post versions of their songs. They don't HAVE to exercise that right, as in the case of Pearl Jam allowing people to freely share (not sell) their bootlegs. And odds are most composers probably wouldn't bother or notice an abc file that's only playable in LOTRO. But if they do notice and do want to bother they can restrict people from posting their songs. So basically I'm avoiding posting things I'm not comfortable with, and at the moment that means sticking mainly to the classical pieces. (Not to mention I've gotten requests to do more classics anyway. So this gives me plenty of an excuse to focus on that.)

    Thumbs up Re: ABC Songbook

    Some songs I'd like to see put up; trying to think of some that are not only cool, but simple enough to transfer over:

    Light My fire, Doors
    The Good the Bad and the Ugly, Ennio Morricone
    Miss You - Rolling Stones
    Ecstacy of Gold, Ennio Morricone
    Cottoneye Joe, Rednex
    Land Down Under, Men at Work
    Buffy/Angel themes
    Bring Me To Life, Evanesence
    Bother, Stone Sour
    Serenity, Godsmack
    Conan the Barbarian theme
    Lightning Crashes, Live

    I think these would be a valuable contribution to Middle-Earth. Thanks in advance.

    Re: ABC Songbook

    I mapped my keyboard for notes and my num pad for any song.

    Right now, 1=C1, F1=C#1, 2=D, F2=D#1, etc, A=C2, W=C#2, etc, lctrl=C3, lshift=C#3, etc.

    I mapped my num pad to play Scarlatti's "Folia" which sounds really cool on the lute.

    7=E2, 9=C#2
    4=F2, 5=A2, 6=D2
    1=G2, 2=C3, 3=E3
    .=F3, numEnter=G3, num+=F3

    Play it in this order as even 16th notes in 6/8 time:

    |: 654646 957979 654646 321313 .25.5. 321313 654646 957979 :| 6

    Since it's hard to do chords, just play them staggered very quickly.

    456 456 3 759 759 9 456 456 96 123 12 3 52. 52. enter 123 .3 456 456 759 456

    That's cool, but I think you posted this to the wrong thread. This thread is for abc file versions of song. You should probably repost your song to http://forums.lotro.com/showthread.php?t=32036 , which is the thread that has the songs you manually play ingame on your keyboard.

    I wonder if we can get a definitive answer regarding copyright issues from the powers that be? It's a shame that someone has felt the need to remove their work due to this.

    I am going to post a thread about this topic so it doesn't get lost in this gigantic body of post. And possibly, we can even get a Turbine Rep to post about it.

So to say nobody can sue you over a bach song, but a jimi hendrix song on the other hand, is hard to understand what your thinking. I just bought a Bach CD last month, that was just recorded, and it is copyrighted. There is no difference between modern day music, and classical music. There is no free public domain material when it comes to music, only free public domain on how it is released.
    There's a difference between copying a recording of a musician's performance and making an arrangement of a composers song. The composer has the right, until his copyright expires, to say who is allowed to make new arrangements of his song and to distribute his song. Musicians don't control the song. Rather, they control any recordings of their individual performances. So the Boston Pops can't sue you for performing Bach, but they could sue you for selling recordings of Boston Pops performances.

    In the case of LOTRO abc files, we're talking about making new arrangements of music, which is the composer's domain, not the performer's.

    Been busy for a while so missed all the copyright discussion. If it is a problem then I would have to shut down the site. I put a paragraph on the Songs page at the site asking for legal advice on the issue. Since the site has had over 50,000 hits there is bound to be some sound legal advice coming in my email. *crosses fingers*.

    I have to agree with Hoho on the composer vs recording artist. And it could be that the "artist" in the heading needs to be the transcriber of the song. Unsure how to mark the abc files. As for the classicals, I would put them along with the old folk songs. Many artists have done their renditions of Bach, etc. along with the old folk songs. So isn't a transcriber only doing their rendition?

    If the site where the transcribers get their midi's and sheet music has no copyright, couldn't someone put them on their site also? And wouldn't that make them legal for anyone to transcribe to another music medium?

    Until this is resolved I won't be updating the site.

    Re: ABC Songbook

    I agree with Mangler on the paranoid part...but I don't necessarily blame anyone in today's world. While I'm not a lawyer (nor am I going to law school – nor do I want to), here is my advice (based on my limited understanding of copyrights) based on a posting arrangement of a previously published work:

    1. Don't claim a work you did not compose as your own.
    2. If the composer, or in the case where the composer is not the copyright owner - the owner of the copyright, asks you to remove your transcriptions of their material, do so immediately and discontinue any further posting of that work.
    3. Don't charge for works for which you do not hold the copyright. (and to address a previous post about why abc files cant be sold on the in-game AH - this is why - especially since you can buy gold for real world money)

    I suspect the operators of the forums here and the servers on which the transcribed music is digitally transmitted and performed (Turbine) , have already done their homework on the copyright issues and have determined that this is a non-issue. After all they are providing a service which allows all of this to go on. This is probably why you will never see the ability to play any MP3s for others to listen to in-game.

    Really when you get down to it, anyone who "performs" and abc version or even the key-mashers who play it outright, would have to abide by any request by the copyright holder to cease and desist, as it could be construed as a "public performance".

    My two-cents...I think you are all blowing this way out of proportion...enjoy the game, enjoy the music system, and for gosh sakes - if you enjoy transcribing music from its original form into abc notataion and posting it here for others to enjoy - ENJOY that too!

    I think you are all doing a great job!

    Aside from the obvious?

    Copyrights for Hendrix's works are held by his estate and or/others who assumed/procured them. Probably a "label" of some sort. Copyrights have an order of precedence (through all of the next of kin) for who gets them if the original author dies, unless the rights are/were sold.

    There are allot of dates associated with copyrights:

    Generally if the work was created on/after (1 Jan) 1978 the term is the life of the author plus 70 years.

    If it was created before then it gets a bit more tricky. If it was in its first term of copyright (on 1 Jan 1978) then it gets twenty-something years from the date it secured its original copyright. I think there are some extensions that can be granted resulting in another sixty-some-odd years of copyright protection. I have no idea what the length of a "term" was. (I could probably look it up, but it really doesnt matter)

    So to answer your question: Bach no longer has any copyright protection (if it were available when he was composing), and Hendrix's works still do (because it was available and is covered by the law). If Hendrix were composing in Bach's time, his works would no longer be protected either.

    At least thats how I understand it...

    Well, maybe I should point you to the hundreds of sites with the free midi files? I've seen the whole LOTR soundtrack posted as midi for free. The music industry doesn't care about midi files they care about MP3's. People don't by CD's when they can download them for free which is why they are suing people sharing MP3s. No one is going to get a LOTRO ABC file of a song instead of buying a CD.

    Anyway, there are lots of other bands that encourage their fans to bootleg and trade their shows. Lot's of Grateful Dead songs were in fact folk songs they did covers of so I would think many of their songs would be fair game. But the point I'm trying to make is that, if a band let's you freely share a recording of their actual performance they aren't going to sue you for an ABC file only fit for LOTRO. I can make a list of bands that encourage bootleg trading so maybe you and everyone else won't rule out the rest of the non classical music. I love classical music too but I really feel it's the more commercial music that will draw more people to the music system. If everyone starts ruling it out all songs that are remotely modern it will be a sad day for music in LOTRO.

    As stated in another thread, many MIDI sites and ABC notation sites have fallen under fire recently and had strong requests made to have certain music files removed or face legal action.

    Also as stated in the same thread, very recently NIN (Nine Inch Nails) was threatened with legal action over the distribution of their own music. On the most recent European Tour, they left flash drives purposely leaking the new CD and the RIAA threatened them with legal action. For every band that wants to encourage bootlegs of their music, there is an agency waiting to tell them how wrong they are. It's not the bands persay who threaten to sue, but the publishers and collection agencies. Bands hire them to protect thier music, and they do just that. Even at the expense of the band's wants or wishes.

    I think you should all relax a bit and realise that even should an artist wage war on your site to take his music off. You will be contacted and warned about it first. Nobody is going to show up at your door with handcuffs in the morning. If you realy do end up on the radar of an artist or their lawyers simply comply with their request to remove the offending files and go on with your day. =)If these forums were to come under notice im sure it is turbine that will be contacted to remove all the material and not the indavidual posters.Oh and never believe everything you read in forum posts. They tend to breed paranoia :P

    Good lord the paranoia is getting worse and worse. Whats next? If you play online games you are going to die now so you can't play no more? Chill out and get to converting the music. As all of you quacks have said if they think you are doing something wrong they will ask you to stop. So how did we go from asking to stop to we are suing you right now for billions of dollars right now?

    Nobody will convert for you anymore. People are afraid big brother will sue their shorts off. Until the paranoia clears music is over for those of us who can't read music or get midi to abc converters to actually work.

    Re: ABC Songbook

    Okay I'm gonna be completely honest. The first thing that came to my mind when i read there was copyright issues for playing a song in a MMORPG LOTR game was, and I quote: "What the hell?". What kind of person would be so cruel as to complain about people playing their songs in a video game. Okay, so people are performing in front of people - actually they aren't. Their digital image of a fictional character if "Performing" in front of other digital images of ficticious characters. So, as the law that would state that they can't perform in front of people, they aren't. That's -1 legal problem. Next, they are pushing buttons on a keyboard, not actually playing the song. I could understand if they were actually playing it with an instrument but they aren't. Their in-game digital images of fictitious characters are playing a digital image of an instrument. -2 legal problems. In my opinion, this is all just a big thing that everyone's overblown and gone crazy over that isn't even illegal at all. We aren't stealing anything, because we ourselves aren't playing it. Our CHARACTERs are. So slam that in their face and say "Hey, eat it."
