The following terms and conditions apply to The Lord of the Rings Online™: Mines of Moria™ Pre-order Program:

1. Only players located in the U.S. and Canada (excluding Quebec) who purchase a Pre-order for The Lord of the Rings Online™: Mines of Moria™ (the “Expansion”), theexpansion to the online PC game known as The Lord of the Rings Online™: Shadows of Angmar™ (the “Original Game,” and together with the Expansion, the “Game”) from authorized vendors are eligible for this Pre-order Program (each a “Player”).
2. Pre-orders purchased at retail do not contain or provide access to the Game.  The Game will be sold separately when the Expansion is first commercially released in the U.S. and Canada (the “Launch”).  Purchase of the Expansion (by existing subscribers of the Original Game at retail) or purchase of the complete Game (by new customers at retail), as applicable, and activation of the associated Launch Product Key and Pre-order Product Key is required to take advantage of the Pre-order Program.  The Pre-order Program expires on the thirtieth (30th) day after Launch (the “Expiration Date”).  The currently anticipated Launch date of the Expansion in the U.S. and Canada is November 18, 2008.
3. The Pre-order Program includes the following:
   1. Special pricing options - specifically, either a multi-month subscription plan or a Lifetime Membership plan for online access to the Game (“Pre-order Pricing Options”).  Players may select one of the following Pre-order Pricing Options, subject to the conditions set forth below:  (i) a three-month ($29.97), six-month ($58.00) or twelve-month ($112.40) online subscription to the Game, or (ii) a $199.00 one-time fee for Lifetime Membership online access to the Game.  The Lifetime Membership will afford a Player who purchases the Launch version of the Game with online access to the Game in the U.S. or Canada without additional subscription fees for so long as the service provider determines, in its sole and absolute discretion, to make the Game commercially available (as opposed to the lifetime of the Player).  Players who select a Pre-order Pricing Option and do not have a paid online subscription account for the Original Game will be billed for their selected Pre-order Pricing Option after the expiration of the initial thirty (30)-day free trial period included with the retail version of the Game (i.e. 30 days after activation of a Launch Product Key).   Players who select a Pre-order Pricing Option and have a paid online subscription account for the Original Game will be billed for their selected Pre-order Pricing Option after the end of their current subscription period for the Original Game and expiration of any free trial periods.  The Pre-order Pricing Option will not apply if a Player’s Game account is terminated for any duration of time due to cancellation, non-payment or otherwise.  If a Game account is re-activated after an account termination, the then current online services pricing terms for the Game will apply.  This Pre-order Pricing Option is only available if both the Pre-order Product Key and Launch Product Key are activated on or prior to the Expiration Date (i.e., 30 days after Launch).
   2. Special In-Game Items - specifically, a Player who activates his/her Pre-order Product Key and Launch Product Key on or prior to the Expiration Date (i.e., 30 days after Launch) will receive one character title, one cloak and one in-game token, redeemable for one of eight special in-game items.  Certain retailers may offer additional special in-game items.  See participating retailers for details.
4. Purchases are non-refundable, subject to applicable laws.  Pre-order Product Keys are non-transferable. 
5. Game-play requires Internet connection.  Players are responsible for their own telecommunications charges.  Online subscription fees apply.  Players’ personal computers must meet certain minimum system requirements to play the Game; however, the recommended system requirements are advised for better performance.  The minimum and recommended system requirements specified in the Pre-order materials are based on the pre-release version of game.  The system requirements for the Launch version of the Game may differ from those specified in such Pre-order materials.  System requirements may change from time to time.
6. Acceptance of the applicable end user license agreement and terms of service is required for access to the live service at Launch.
