TERMS AND CONDITIONS

The following terms and conditions apply to The Lord of the Rings Online™: Mines of Moria™ Early Upgrade Program:

1. Only following individuals are eligible for this Early Upgrade Program (“Player”): Those individuals located in the U.S. and Canada (excluding Quebec) who: (a) purchase a digital upgrade (an “Early Upgrade”) for The Lord of the Rings Online™: Mines of Moria™ (the “Expansion”), theexpansion to the online PC game known as The Lord of the Rings Online™: Shadows of Angmar™ (the “Original Game,” and together with the Expansion, the “Game”), and have an existing paid online subscription account for the Original Game from Turbine, Inc. (each a “Existing Subscriber”); or (b) purchase a digital download form (“Digital Download”) of the complete edition of Game (i.e. which includes both the Expansion and the Original Game) in connection with their participation in Turbine’s The Lord of the Rings Online™ free trial program which commenced on August 29, 2008(each a, “Free Trial Purchaser”).  
2. The Expansion will not be available for play until after the Expansion or Game is first commercially released in the U.S. and Canada (the “Launch”).   The currently anticipated Launch date of the Expansion in the U.S. and Canada is November 18, 2008. The Early Upgrade Program shall be available through midnight (Eastern Time) on the day prior to the Launch date.  [Free Trial Purchasers may subscribe to and play the Original Game upon purchase of the digital download form of the complete edition of Game.]
3. The Early Upgrade Program includes the following:
   1. Special pricing options - specifically, either a multi-month subscription plan or a Lifetime Membership plan for online access to the Game (“Early Upgrade Pricing Options”).  Players may select one of the following Early Upgrade Pricing Options, subject to the conditions set forth below:  (i) a one-month ($14.99), three-month ($29.97), six-month ($58.00) or twelve-month ($112.40) online subscription to the Game, or (iii) a $199.00 one-time fee for Lifetime Membership online access to the Game.  The Lifetime Membership will afford a Player with online access to the Game in the U.S. or Canada without additional subscription fees for so long as the service provider determines, in its sole and absolute discretion, to make the Game commercially available (as opposed to the lifetime of the Player).  Existing Subscribers will be billed for their selected Early Upgrade Pricing Option after the end of their current subscription period for the Original Game.  The Early Upgrade Pricing Option will not apply if a Player’s Game account is terminated for any duration of time due to cancellation, non-payment or otherwise.  If a Game account is re-activated after an account termination, the then current online services pricing terms for the Game will apply.  
   2. Special In-Game Items - specifically, each Player will receive one character title, one cloak and three in-game tokens, redeemable for one of eight special in-game items.  
4. Players will be charged for the Early Upgrade purchase plus applicable sales taxes immediately upon purchase.  NOTE:  For residents of Texas and Washington:  Turbine will automatically apply the maximum sales tax rate applicable to any resident of your state for your Early Upgrade or Digital Download purchase.  Even if you reside in a county or municipality with a lower sales tax rate, you will be charged as if you reside in the county or municipality with the highest sales tax rate in your state.
5. Early Upgrade and Digital Download purchases, including state and local sales taxes, are non-refundable, subject to applicable laws.  Early Upgrade Program benefits are non-transferable. 
6. Game-play requires Internet connection.  Players are responsible for their own telecommunications charges.  Online subscription fees apply.  Players’ personal computers must meet certain minimum system requirements to play the Game; however, the recommended system requirements are advised for better performance.  System requirements may change from time to time.
7. Acceptance of the applicable end user license agreement and terms of service is required for access to the Game.

By purchasing an Early Upgrade or Digital Download of the Game, you hereby agree to the foregoing terms and conditions (which may be modified or updated from time to time on www.lotro.com).
